Belderbos Solicitors’ Nick Robertshaw achieves specialist accreditation for financial expertise

Nick Robertshaw, Family Law specialist at Belderbos Solicitors, has been awarded the Resolution Specialist Accreditation for providing advice to clients on complex financial matters.

The accreditation is a mark of excellence in practice, recognised by the public, fellow professionals, the judiciary and the Legal Aid Agency, and demonstrates that a lawyer has specialist expertise in a specific area of family law.

Nick is now accredited by Resolution as being a Specialist Lawyer in:

  1. Complex Financial Remedies in respect of middle/high income and assets
  2. Complex Financial Remedies in respect of complex low income and assets

Candidates for the Resolution specialist accreditation scheme go through a rigorous assessment and must demonstrate thorough knowledge of law, procedure and practice, and a high level of skill, proficiency and experience in their specialist areas of family law. Candidates are also required to demonstrate that they act for their clients in a constructive way, putting the best interests of any children first, in accordance with Resolution’s Code of Practice.

Nick’s accreditation is for providing advice and representing clients on matters including:

  • Relevant law and considerations in respect of inherited assets, pre-acquired and post-separation assets
  • Relevant law and procedures in relation to Trusts, any associated tax issues, the Courts powers to vary, and offshore trusts 
  • Relevant law and procedures in relation to company assets, their division upon divorce and tax consequences
  • International aspects in general, for example jurisdiction, assets held abroad, how the courts of England and Wales deal with such and enforcement
  • Law and procedure in respect of interim maintenance (maintenance pending suit) applications
  • Child maintenance when income exceeds CMS maximum assessment: school fees orders: tertiary education orders
  • Tax liability including Income Tax, Capital Gains Tax (including in relation to asset transfers, tax year of separation, SDLT, etc) and Entrepreneur’s relief
  • Relevant pensions legislation
  • Law and procedure for joinder of parties (third party interveners such as trustees, companies and/or family members) 
  • Relevant legislation and case law on the treatment of share options, bonuses and future income
  • Resolution of financial claims where assets are less extensive or where there may be debt or redundancy
  • Mortgages, repossession proceedings
