The Collaborative Family Law Method
Under the Collaborative Family Law Method, couples work together to settle the issues arising from their separation. Those issues might relate to the division of assets, payment of spousal or child maintenance, and child living arrangements.
The couple sits around a table, supported by their legal advisors, undertakes an open and frank discussion about the issues and seeks to reach an amicable agreement suitable to all involved. The meeting can be arranged quickly, is extremely cost-effective and places far less stress on the whole family, including the children, than many other dispute resolution methods. Since the Court is not involved, couples tend to be more likely to speak honestly about their position and settlement hopes. They are also at liberty to agree any arrangements appropriate to their family’s individual circumstances, free from the constraints of the remedies legally available.

Mediation
Mediation is a form of dispute resolution whereby an impartial third party, known as the Mediator, works with the couple to resolve the issues between them.
The couple can choose the Mediator, who will be a professional with experience in family law matters. They can also select the date, time, venue and format of the Mediation, which might be an around the table meeting, the couple sitting in different rooms with their legal advisors, or a combination of approaches. Sometimes, the Mediation can be held online, via Teams or Zoom.
Most couples find the flexibility and relatively informal nature of a Mediation make for a less stressful experience than a Court hearing and are often surprised by its effectiveness. Mediations can be arranged far more quickly than Court proceedings and are a much cheaper option.

Early Neutral Evaluation
Unsurprisingly, the financial aspects that arise from a separation are often some of the hardest fought. The Early Neutral Evaluation is a form of dispute resolution often used to assist a couple in understanding the likely outcome of the financial elements of their separation, should the issues proceed to litigation.
At an Early Neutral Evaluation, an impartial third party will hear and assess the evidence of both spouses and go on to explain their view of the case and suggest what a Judge is likely to decide. The impartial third party will have extensive experience in family law matters and is often a senior family law barrister. Their evaluation is based on years of experience in family law disputes and the family law Courts.
By the spouses gaining a greater appreciation of the strength of their respective positions, the likelihood of settlement is increased, and Court proceedings become less likely.
